PlayInnové Workshop & Event Terms and Conditions Last Updated: January 12, 2026 By registering for or participating in any workshop, training, event, retreat, or related activity (collectively, an “Event”) offered by PlayInnove LLC, a California limited liability company (“PlayInnové,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not register for or participate in any Event. Participation & Assumption of Risk Participation in Events may involve physical movement, use of tools or materials, group interaction, travel, environmental exposure, and other activities that carry inherent risks. While reasonable efforts are made to promote safety and accessibility, risks may include, without limitation, minor injury, illness, allergic reactions, property damage, emotional discomfort, or unforeseen circumstances. You voluntarily assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable. You are responsible for determining your own physical, mental, and emotional readiness to participate. You acknowledge that Events may occur at third-party venues or outdoor locations and agree that PlayInnové is not responsible for the condition, safety, or operations of such venues. You agree not to attend if you are experiencing symptoms of illness or have been advised to isolate. PlayInnové does not guarantee prevention of illness exposure. Because our Events often involve hands-on materials, physical movement, creative tools, group interaction, and third-party venues, accommodation options may vary depending on the format, location, timing, and nature of the experience. Participants who require accommodations related to accessibility, mobility, sensory needs, neurodiversity, medical considerations, or other support needs are encouraged to contact PlayInnové as early as possible prior to the Event so that reasonable options may be explored. Liability Waiver & Release To the fullest extent permitted by California law, you knowingly and voluntarily release, waive, and discharge PlayInnové and its owners, officers, employees, contractors, facilitators, agents, partners, affiliates, and venue partners from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to your participation in an Event, including personal injury, illness, death, emotional distress, loss of property, or economic loss. This release includes claims arising from the ordinary negligence of PlayInnové. This release does not apply to claims arising from PlayInnové’s gross negligence, reckless conduct, or willful misconduct. Personal Property PlayInnové is not responsible for loss, theft, or damage to personal belongings during Events. You are solely responsible for securing your personal property. Intellectual Property & Use of Materials All Event content, facilitation designs, frameworks, exercises, prompts, tools, methodologies, trademarks, visuals, and materials (collectively, “Materials”) are the intellectual property of PlayInnové or its licensors and are protected by applicable intellectual property laws. Your participation grants you a limited, personal, non-exclusive, non-transferable license to use the Materials solely for your own learning, reflection, and professional development. This license does not permit you to reproduce, distribute, publish, display, sell, sublicense, train others, facilitate workshops, create derivative works, or otherwise commercially exploit the Materials without prior written permission from PlayInnové. You may not represent PlayInnové Materials as your own work, nor use them to develop competing programs, workshops, products, or services. Participants are welcome to share photos of their own creations and reflections about their experience, provided that PlayInnové’s proprietary prompts, facilitation materials, frameworks, or instructional content are not disclosed or reproduced. Commercial use or redistribution of PlayInnové Materials remains prohibited without prior written consent. No Recording Policy To protect intellectual property and maintain a psychologically safe learning environment, audio recording, video recording, photography of materials, screen capture, or live streaming during Events is prohibited unless expressly authorized in writing by PlayInnové. Unauthorized recording or distribution may result in removal from the Event without refund and may result in legal action. Media Release PlayInnové may capture photographs, video recordings, or testimonials during Events for marketing, educational, or promotional purposes. By participating, you grant PlayInnové permission to use your name, likeness, image, voice, and statements captured during the Event for marketing, educational, and promotional purposes, without compensation and without further approval. This permission is perpetual and worldwide. If you do not wish to be included in media, you must notify PlayInnové in writing prior to the Event. Confidentiality & Participant Conduct Events may include experiential activities and fictionalized scenarios. You agree not to disclose confidential, proprietary, or personally identifiable information belonging to your employer, clients, or any third party during participation. You agree to engage respectfully, maintain psychological safety, and follow facilitator guidelines. PlayInnové reserves the right to remove any participant whose conduct is disruptive, unsafe, or inappropriate, without refund. Communications & Certificates By registering, you consent to receive Event-related communications from PlayInnové, including logistical information, certificates of completion, and credit documentation when applicable. You may opt out of marketing communications at any time; however, operational communications related to your participation may still be sent. Accreditation Disclaimer Some Events may be eligible for graduate-level professional development units (C4T/UOP) or professional recertification credits (including SHRM, HRCI, or similar organizations). PlayInnové does not guarantee acceptance or approval of credits by any credentialing body. Participants are responsible for submitting and tracking their own credits. Cancellations, Transfers & Refunds Cancellation, refund, and transfer policies vary by Event and will be communicated at registration or checkout. Unless otherwise stated, registration fees are non-refundable once an Event has commenced. PlayInnové reserves the right to modify, reschedule, or cancel Events due to low enrollment, facilitator availability, venue issues, force majeure, or other unforeseen circumstances. If an Event is canceled by PlayInnové, participants will receive a refund or credit as determined by PlayInnové. Force Majeure PlayInnové shall not be liable for delay or failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, public health emergencies, government restrictions, labor disputes, power outages, transportation disruptions, or venue closures. Governing Law & Venue These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Subject to the Dispute Resolution & Binding Arbitration section below, any court proceedings shall be brought in a court of competent jurisdiction within the State of California. Dispute Resolution & Binding Arbitration Any dispute, claim, or controversy arising out of or relating to these Terms, your participation in any Event, or your relationship with PlayInnové, including claims based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, unless the parties mutually agree to a different arbitration provider. The arbitration shall be conducted by a single neutral arbitrator in the State of California, unless the parties agree otherwise. Judgment on the arbitrator’s award may be entered in any court having jurisdiction. Each party shall bear its own legal fees and costs unless otherwise required by law or awarded by the arbitrator. PlayInnové will pay any arbitration filing fees in excess of what you would be required to pay to file a lawsuit in a California court of competent jurisdiction, unless the arbitrator determines your claims are frivolous. YOU AND PLAYINNOVÉ AGREE THAT EACH PARTY IS WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION. This arbitration provision shall survive termination of these Terms. Severability If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Entire Agreement These Terms constitute the entire agreement between you and PlayInnové relating to Event participation and supersede all prior communications or agreements relating to the same subject matter.
